See, this is the problem when governments and courts uphold the rule of law. If only Austria had a much more corrupt government and an authoritarian ruler who bent the courts to his will! Then all the Ryanair boss would have to do is pay the right bribe to the ruler, and all...

The issue there is that Ryanair operates Lauda Europe which is based in Vienna, so it would take some major restructuring

Two thoughts: - The airline is being both a jerk and an idiot for not setting the issue for less than €1000. Even if they intentionally do not want to pony up the cash as a principle, they should have at least show up to court to fight if they don't want a default judgement ...

If the latter happens, I'd assume the government could seize the landing slots or something, effectively banning Ryanair from landing in the country or using their airspace. Since Austria is a EU member, that could apply throughout EU/EEA.

Ryanair specifically already does this. No planes are held by the company. They all belong to some subsidiary leasing company with a generic name.

UK law is extremely permissive to those kinds of corporate shenanigans but I would be surprised if that leaseback scheme would actually stop an EU country from seizing the plane if they really wanted to.

Pay out rates for EC261 compared to amounts due if everyone successfully claimed are pitifully low. Crazy system where similarly situated pax get a multiple of fare paid or 0.

EC261 only works if airlines believe “ignore it” will cost more than “pay it.” The moment courts start treating planes like collectible collateral, the message gets a lot clearer
